Hello all, with the August bulletin showing June 06 cut-off dates, I have the following questions for which I seek input form IV members.
1. Is it possible to apply for the GC, the second time, if one cancels his GC "without prejudice"?
2. If yes, is it possible to use the priority date of the canceled GC in the second GC application?
3. What are the points one should be aware in canceling GC "without prejudice"?

I have worked for Company "A"(Ex-employer) under H1-B(company A holding my H1-b) from 2007-2010. During 2009 & 2010, company A was unable to clear all my payments as the company went through some financial hurdles but they issued W-2 for the amount paid in fiscal year 2009. Now, company A has got money and they decided to clear my back wages for 2009-2010 through 1099 form. I transferred my H1-B visa to Company B(2010) then to Company C(current employer). Now, Company C has started my Green card(GC) process.
Questions:
1. I already received W2 for 2009. Can company A amend the W2 for the back wages?
2. Is it legal to take the unpaid amount under 1099? Will it affect my GC process?
3. What are my options to get my back wages from company A?
4. Company A want to issue 1099 along with a letter stating that i was full time employee for the time period mentioned in 1099. Is it acceptable?
I really appreciate your help for taking your valuable time in clarifying my questions. I look forward for your reply.

I work for company A in india which has a subsidary company "B" in US.
On "B"'s request i worked in US for company B from July 2006 to Nov 2006 (for which i have valid pay checks).
I went back to India and worked for A till June and i came to US again to work for Company B.
Now as soon as i entered US, i have applied for a premium H1 company transfer to Company C.
Now i got a query to submit my Pay checks which i do not have as i resigned Company B after coming to US.
Please suggest me whats the ideal way to answer this query...

I recently got my EAD card. I intent to continue to work full time with my current employer. I want to work part time with another employer. My H1 is stamped and valid untill end of 2008.
If I use my EAD card for part-time job, does my H1 get invalid?
If yes, do I need to inform my fulltime employer about change in status?
If no, can I travel outside USA with the H1 visa for reentry?
Please help.

"On behalf of the Republican side," he said, "I object." We object to the obstruction.
Honestly, what is the big deal here? Filing campaign finance reports electronically has been standard operating procedure for candidates for the House of Representatives and the White House for years -- as it has been for political parties, political action committees and "527" groups. Yet Senate candidates are still trudging down to the Senate Office of Public Records with paper copies of their reports, which are then passed along to the Federal Election Commission, which sends them to a vendor that punches in the information and zaps it back to the FEC electronically. That finally makes them widely available, sometimes too late for voters to see who's donating to whom and how the money is being spent. With this seeming fear of modernity, it's a wonder the Senate isn't calculating budgets with an abacus. Or is it a fear of disclosure?
After the bill was blocked, Ms. Feinstein, chairman of the Senate Rules and Administration Committee, said, "It is very hard for me to understand who could oppose this and what their reason for opposing it could be." Long-standing Senate custom allows the objection of a single senator to stop a bill in its tracks -- it's known as a secret hold. A measure that passed the Senate earlier this year, and awaits a House vote, would eliminate the practice.
The hold unleashed a torrent of activity on the Internet, as bloggers tried to flush out the identity of the senator responsible for the hold. But after an onslaught of phone calls to Senate offices, the bloggers have no answer. No one owned up to being the culprit.
Yesterday, the bill's sponsor tried again. And again, the Republican floor leader objected. A spokesman for Senate Minority Leader Mitch McConnell (R-Ky.) said he is sure the name of the secret senator is known "in the cloakroom," but he said that misses the point.
"A hold can't stop something from coming to the floor," Don Stewart said. "It can only stop it from being pushed through without a full and open debate on the bill."
That's true -- sponsors had been trying to pass the bill by unanimous consent, which does not permit amendment or debate. But Feingold told the liberal blog Daily Kos that the path was typical for a bill with 35 bipartisan co-sponsors that did not elicit a single objection in committee.
Writing on the blog yesterday, Feingold said: "The fact is that someone anonymously blocked the bill, . . . that person has made no effort to resolve his or her concerns with us, and the Republican leadership won't even tell us who that person is."

This reflects an increase of 100 cases from the prior count, provided on August 14, 2009. The advanced-degree cap remains at 20,000. We suggest to US employers to file H-1B Petitions only if they can able to provide the Client details like Letter from the end-client, Work-orders confirming the placement. If you are having an in-house requirement, provide USCIS with ample proof of your in-house requirements. Considering the flood of H-1B RFEs, we have to be bit cautious in filing works. The standard approach prevailing until last year needs a re-look. Be assured, if you are right on papers and abide the Immigration requirement, you will for sure come with flying colors. USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. Right now, employers have to go to all the trouble of preparing a case that may be rejected simply because the visa allocation is filled. I think...

Guys,
I need to find out what documents I need to send after I file I-765 online. DO anyone has the experience in this matter. I filed my I-485 and at tht time i did not filed my I756 just to avoid lawyer's fee.
The form says I need to send a copy of I-94 and photo thats all, but the confirmation notice I received after filing the form online said that do not send any photo's or any identification document and the notice said that they will sent me a Biometric appointment.
DO anyone has info on this

Last year I had a serious fire injury and was burned >60% . I was in the hospital for most of 2009 but back to work again. However, during this fire my both hands were badly burned and lost finger tips of both hands.
I have 485 pending and working on EAD. But not sure how this will impact my green card process ( if finger printing is required) or my reentry in US on Advance Parole. I would like to travel and visit India soon.
Any suggestions recommendations are highly appreciated.

But I just submit I-765 (EAD) renew by 6/22/08. Now I found out my I-140 and I-485 are all approved. Can I revoke or withdraw I-765(EAD) from USCIS?
