The Orignial Spector Markup Deleted This Provision From The Ina. This Is A Big Blow To Oversbuscribing Countries, Unless The Current Markup Is Modified Thro An Amendment.

The following are the reason for Eb3 situation.
Anyone who have 3 year or 4 year degree can apply. So Other country also there is a demand. So it is nearly impossible to get other country quota. For a few thousand green cards atleast 100k persons might have applied till 2008 in EB3. So there is not much chance for improvement. It may move a few months to 2 years in 2009.If some bill is passed then most persons will get relief. But still some chances for recapture bill in house. But the reaction at Senate to be seen. Next year they may give a best attempt for CIR so that Congressmen will get a chance to do overtime also for hot news in Media. As usual CIR is unpredictable at best.
I think they are talking about EB3 Mexico... Doesn't make any sense for EB3-India as it has already been unavailable.. so what does heavy load signifies... I am positive EB3-I will open up... may be more retrogressed than last availability.. but it will be available on Oct 1...

True - it applies to everyone. The difference is, some people look at it as fate, some people try to do best out of it and some try to do something for betterment. IV and some serious IV members are of the third type whereas the reast of folks are first and second types :)

For all the replies to my post. I understand that there are many others in the same situation I am in, who can understand and feel the injustices of this process.
I understand that we made personal choices and we have to take responsibility for our actions, if something is clear is that h1-B is a NON-EMIGRANT visa. I just wish there was more transparency from the USA government when it comes to apply for PR through employment. The backlogs and collapse of the system, only reflect the lack of interest in solving the problem which in my opinion it's also a reflection of the lack of interest in having any more skilled professionals coming to the US.
Most of the participants in this forum are from India. I appreciate your insights and wisdom, you are well known for being spiritual people who work hard through hardships in life. Many of you have left here important advices and I am grateful for that.
Personally I have done my best to live a life outside this green card ordeal. I have moved on trying to live a normal life without being obsessed with this problem, but as most of you know, reality hits quite often and we are reminded of the limitations that our legal position imposes, more often than not.
I am only regret the rude comment of somebody who replied saying " Give up something you don't have? Live a life". It's true I don't have anything to give up and that is the sad part of all this process. I have invested thousands of dollars from my own pocket, gone under distress and suffered the unfairness of the system in exchange of nothing. Yet.

Like many immigrants, I moved to USA in search of American Dream. With a degree in Computer Science and valuable experience, I thought I could pursue my ambition to excel in my field, while also fulfilling my American Dream. My dream of America was about freedom. Freedom of working at niche companies, living a comfortable life, earning higher wages than what I used to earn in my Home country. What started out as a dream has turned to a nightmare. Like many others I came to USA on H1-B and wanted to convert to a permanent resident. The process, which used to take 2-3 years, has turned to uncertainty. The path for Permanent residency has been entangled in complicated government laws and bureaucracy. I had to wait in line for 4 years just to get my labor application approved and now I am struck in another queue of retrogression. I moved from my country; because I did not want to wait in line at Ration shops, bus stops. I wanted to escape from the lines, but now I am struck in a bigger line with no end in sight.
Whenever there is a discussion about immigration, People always assume it as about illegal immigration. So I have to keep reminding people that there is another side to immigration. Legal immigration. The issues of legal immigrants have been ignored and been buried in the midst of illegal immigration controversies. When I send letters to House Representatives/Senators about the problems of legal immigrants, they reply back about increasing H1-B numbers. Legal immigration is NOT just about just increasing H1-B. Also the anti immigration groups publish that people on H1-B don�t pay taxes. But we pay taxes, Medicare and social security like all other American citizens. With the current immigration laws, we might not be even to avail the benefits of these taxes.
The facts of the legal immigrants
� We are NOT here to take American jobs. We fill those positions when a suitable American citizen was not found
� We PAY TAXES like any other American citizens
� We are here legally. The government has assessed our qualifications and education.
� According to Economic Report of the President, 2006 - Legal skilled immigrants increase productivity growth and improve the standard of living for the U.S. population as a whole.
� According to Economic Report of the President, 2006, skilled immigrants constituted 76% of the employment growth in the Executive, Managerial, Professional (e.g., Scientists, Doctors) and Technical (e.g., Health and Science Technicians) categories from 1996 to 2002.
� According to Annalee Saxenian, �Silicon Valley's New Immigrant Entrepreneurs,� Public Policy Institute of California, 1999, in 1998, Chinese or Indian CEOs ran 24 percent of Silicon Valley�s technology firms. These companies accounted for over $16.8 billion in sales and 58,282 jobs. These numbers may still understate the scale of immigrant entrepreneurship in the region because firms started by Chinese or Indians with non-Asian CEOs were not counted.
We are being backlashed by the congress and the anti immigration groups, even though we are highly skilled, well educated and staying legally. We have done nothing but help America in its economic growth and in its quest for innovation and technology. Now we are being punished for being here legally and law abiding by putting us in retrogression. We cannot get Salary hike, or promotions when our green card is in process. So while my American colleagues have moved to greener pastures, I am struck here at the same job and same salary. People struck in green card process cannot open new ventures. The new ventures would open new jobs and increases America�s competitive edge in innovation and global leadership in technology. If American congress does not act at this point of time, there will be a �BRAIN DRAIN�. People fed up with retrogression have already started looking at other countries like Australia, Canada who are welcoming high skilled immigrants with open arms and easy migration laws. As for me I have invested my prime youth for my American dream and hope American government will embrace high skilled immigrants like me. Rep. Shadegg has tabled H.R. 5744, SKIL bill for legal high-skilled immigration. This bill would reduce the current wait time for getting the green card. I sincerely urge congress to pass SKIL bill which will reduce the wait times and help high skill immigrants help America to sustain it�s edge on technology and global innovation.
We are getting more calls for op-eds and need more IV members to pitch in and write articles.

So July visa bulletin is out ... we will see comments with frustation and appeals to fight for the cause ... however, this is a prediction thread, so my prediction is that by next week, all affected people will accept the reality and will move on with their life waiting for August visa bulletin or for the next year quota. My purpose is not to offend anyone, but this is just the observation we all had in the past, so why this time around its going to be any different?
Now as far as those three bills are concerned ... at times I feel that they are just pacifiers to amuse the crying babies. We all can see that immigration related bill (fashion models, regional investors etc) are getting passed, but not the one's that we really want. Therefore hearings in the sub-committie and than in full hearings will go on till August, and afterwards presidential election will be the focus ... immigration reforms will take a back seat. New administration in 2009 will have more immediate priorities to fix the economy, war, etc. Immigration will eventually appear on the radar, but only after some time.
So only movement I can see in near future is EB3 to EB2 conversion. That's OK too. because everyone has a right to straddle the lanes. Out of that stampede, some will get approved, some will get rejected, and will create more mess in the system. But that's inevitable ... and if a mass transition happens, USCIS will have no other option to bring in yet another rule to make their life easy, we all can guess ... what that may be ... I think this is one of the reasons why USCIS does not allow 140 premium processing anymore. Now those who are hopefull for EB2, my message is that USCIS can very easily justify visa wastage this year because of the extra load they got from Citizenship applications. Personally, I do not have much hope of USCIS working efficiently.
I am not trying to spread pessimism, but just giving my predictions. We all need to think hard, as to how can we come out of this mess. Flower campaign worked once, but doesn't mean that its gonna be effective again and again.
Fashion models and Sport personnel and EB-5 folks are few in numbers and will go unnoticed by their constituents. Other EB categories are comparatively huge. So I suppose that congress is treading carefully. If the bills does not go though the subcommittee and full ones, opponents will debate that the bill was sneaked in or piggy backed or pushed through. The america of old, the one that is so organized that every official form includes an estimated time on how long it takes to fill it up. The one where every street has a clear name marker, every intersection has multiple stop lights, multiple signs. Where the little cats-eyes on the road are color coded[1] Where lines form automagically when a bunch of people converge on anything. Where you can go to any .gov site and pick up whatever statistics you want on anything from agriculture, to factories, to healthcare.
This is a nation built on documentation and organization.
For the first time the visa bulletin does not look like some discarded bingo card or four monkeys getting excited on a typewriter. For the first time the numbers make sense, they explain why they are what they are. They even put our prediction threads out of business by coming out with their own set of predictions for the rest of the year.
USCIS has had data like this for eons (how many cases pending in which category and from which country). It took the usual american obsession with data and organizing data to come out with all this.
Kudos to them.
Things remain bleak, but just to see something so neatly organized and put out was heartening to me.
P.S: and no, this is not them just doing their job. Their job is to put out the dates every month (like they have been doing for atleast over a decade). To clearly spell out how many cases are pending (like their recent report), and now to predict how these dates will move, is IMO going beyond the minimum requirements of the job, and is much appreciated.
