I was wondering if this recession could turn out to be a silver lining for those of EB2-I,C who manage to survive it. Come to think of it, with all these job losses theres bound to be a downturn in hiring - resulting in lesser number of EB1 and EB2 ROW applications. This means more could overflow to EB2 I and eventually EB3 (I,C and ROW) survivors will benefit to.
Although we also need to remember that the H1B quota will still get filled up on Apr 1 - recession or not. So don't really know how this would turn out.
What are your opinions folks?

I sent my EAD application on 10/24(Wednesday), reached NSC on 10/26(Friday), Notice date 10/29(Monday), Check cashed 10/30(Tuesday)..Already got I-485 receipts back in August.
So they are Current now.... But what about those July/Aug filers who are still waiting for their receipts? Very unfair to them. I could wait for 2 months to get my EAD receipt if they could first receipt all july august filers...
They are really unpredictable..

HI Gurus,
I am working in Job A and my GC was filed for Job B by my current employer. It has been more than 180 day since my I-485 is pending. Is it possible that I switch employers using AC21 since I have worked for my sponsoring employer for 180 days but in different job. I will appreciate your feedback. Thanks

Once you start working as a trainer, you have violated H-1B status so that you must rely on the EAD for both the gym job and the Systems Analyst position. You must also use Advance Parole, not the H-1B visa, to return after travel.

I am currently on H1B status with 3 yrs left on my visa. I've used 3 yrs already.
I'm not a project at the moment and if I convert to H4 now, can I continue on the same H1 after a couple of yrs.

Anybody filed Un Signed Labor Substitution?
Since the cut off date was Jul 17th my attorney filed un signed Labor substitution with I-140.

My friend was on H1B visa from last 5.5 years and Laid off last week .
I want to know what options she has to stay in USA.
from last company her labor and 140 was approved .
Can she do visa transfer and start new labor ?
Its only 5-6 months left in her 6 year h1b visa .

I think u can as long as prior employer does not revoke i140, please consult a good attorney
Current situation :
Labor approved(eb3 with pd of July 03),
I140 in process,
In my seventh year of H1b on a one year extension expiring in August.
Please advise if I can change employers now and still get a new H1 though I am in my seventh year ?

The New York Times carried on its front page this morning a Nina Bernstein article that will no doubt cause a shake up at Immigration and Customs Enforcement over what can only be described as a major scandal in the way the agency has dealt with sick detainees at the agency's detention facilities around the country. The details described by Bernstein will no doubt enrage you. I tried checking my I-485 status over phone. I called after hours. So it went to the automated message. Thought just to listen what the message says. It was something interesting. Thought to share with you. Do any of you have the same or similar experience?
07/02/2007 - Application Receipt Date in I-485 notice.
09/04/2007 - Application Notice Date in I-485 receipt.
08/01/2007 - Application Receipt date according to the Phone Status(Automated).:confused:
09/01/2007 - Application Receipt date according to the uscis.com website Status check.:confused:
Just curious about these variations as none of these dates are matching.:confused:

Some where in May I heard the news that end of this year USCIS is going to halt concurrent filing of I-140 and I485 and introduce an extra step called preApp of I485 which can be done only after an I40 approval. I would like to know if this is really going to happen?
I have an approved I140 and a PD of Apr 08. I am planning to change the company now. My doubts are
1) Suppose if USCIS changes rules and introduce an extra step for preapp of I485.
What will happen if I switch company after 180 days of preapp of 485. can I invoke Ac21 ?
2) will I be eligible for EAD/Parole after preapp of 485?
