On October 20, the Executive Office for Immigration Review (EOIR) rolled out its new website. The EOIR is composed of the (1) Immigration Courts; (2) Board of Immigration Appeals (BIA) and the (3) Office of the Chief Administrative Hearing Officer (OCAHO). Hello,
Does anyone know any good lawyers in the Northern Virginia/Maryland area ? I've had some bad experiences so I would welcome any recommendations. Please let me know how much they charge for the entire green card process. I appreciate your assistance.

This is the scenario:
1. Husband becomes a LPR this year.
2. Wife still undocumented.
3. Wife was working long time ago, but became a housewife for the past 6 years, so no work.
How would the wife adjust her status under the new CIR if she was not working for the past 6 years?
Would she have to wait until the husband is able to petition her through other regular means?
Any ideas or is it too early to tell how USCIS will issue it's regulations about CIR?

With predictions that the H1B cap will be reached any day now, employers and employees are rushing to beat the cap. United States Citizenship and Immigration Services (USCIS) announced that, as of December 4th, it had received approximately 61,100 H-1B petitions counting toward the congressionally-mandated 65,000 limit. Additionally, USCIS has approved sufficient H-1B petitions for foreign nationals with advanced degrees to meet the exemption of 20,000 from the fiscal year 2010 cap. Any H-1B petition filed on behalf of a foreign national with an advanced degree will now count toward the general H-1B cap of 65,000.
So why are they still accepting cases? Well not all filed H1B petitions will be approved so the final count will not be known until USCIS will clear all denials. We will keep you posted.

I am currently a H1B visa holder engaged to a US citizen. We are planning on going to India soon for the formal engagement ceremony and getting married early next year.
I had two points of concern:
1. Upon returning after the engagement, I will still be on H1B (since the wedding is going to be a bit more than 90 days after the official engagement so the K1 visa is not an option), will this cause issues at port of entry?
2. After marriage, we plan to go abroad for our honeymoon (we likely won't have time to file anything with immigration before our return): how should I proceed upon reentry then or is this even advisable since I'll be returning on an H1 but be married to a US citizen?
Any advice would be greatly appreciated, thanks.

Lets say, after getting EAD and AP and 6 months after filing for I-485, you want to switch jobs to another company but want to do an H1B transfer to a similar position. Do we still have to start the green card process from scratch to remain on H1B?

My friend currently is in his home country. He worked with H1-b before, and left US because of being laid off (could not found a new job in time). His question is if he can apply for B2 and go to the US first, then stay in US looking for a job. After getting an offer, transfer his previous H1-b to a new company. Can he do like that? Thanks!

I transfer my H1B to company B and works for company B. Now suppose if I want to go back to company A after six months and want to work for company A, does the h1b transfer required? (means, does company A requires to file whole h1b petition again?) Here my petition (I-797) with company A is still valid. And suppose if I want to go back to company A after 4 years, at that time my petition (I-797) with company A might be expired, does the company A requires to file new petition (tranfer) or just the extension?

I have 2 clarifications
a)Anyone has a clue on what an Employment Development department letter means? Is this the same as the 45 day acknowledgement letter from DOL?
b) In the absence of an 45 day acknowledgment letter from DOL, how else can we get a confirmation that our case has been filed with DOL. As per our company Attorney DOL is not issuing the 45 day letter. Can I ask for a screen shot. I saw some threads on that.. How do I ask for a screen shot of my case ? Any specific procedure? What is the response time for receving the screen shot? Do you need to specify a reason for asking screen shot?

Could you post the actual percentage of EB legal immigrants. If it is 15% then it is sad. It should be at least 50% in order for the country to have the brightest talent.
Out of 1 million green cards issued every year, 140000 goes to EB immigrants which works out to 14%

Is there anyone whose I485 is pending for more than 90 days. My I-485 was sent on July 18th. I called USCIS twice and they are asking me to call them on Oct 17th (when 90 days is completed). They are saying that my appl.n should be in by then. Is there any one whose checks got cleared after 90 days. If not, what did you do about it.

You should move this to the Immigrant Visa forum for more responses.
You should notify CIS that you have changed address and ask that the interview be rescheduled. Hopefully you filed the AR-11, change of address forms, with CIS when you moved
