    My recent EAD renewal had issues with the validity dates so I sent both the EAD (mine and my spouse) for correction. I received my EAD back with dates corrected but not for my wife. I called USCIS and one nice rep sent an email to the EAD supervisor requesting action but this was only a week ago. My wife now has a job offer but she is unsure if she could proceed due to lack of a EAD. This is obviously very frustrating for her since it was so hard to find a entry level job in this economy

    I got a infopass but only for next week and it will be a little too late for the new job. She has to report to work next week. Any suggestions/thoughts for a way out will be helpful. FYI 90 days have passed since my initial EAD renewal application. I am considering opening a SR but that has a time line of 60-90 days

    Hi,

    I m without an assignment for about 3 months, but I m maintaining my status bcoz the employer is running the payroll with minimum salary. mean while i m expecting a full time offer from a company and they are willing to transfer the visa. so my question is that when the new company will be asking for the paystubs for the transfer, I have the paystubs which have a reduced(minimum) salary than what I was earning when I had a project, so will it affect my job offer or any questions will be asked by USCIS?

    i know the questions are pretty open, I would appreciate any replies/advice on this,

    My friend currently is in his home country. He worked with H1-b before, and left US because of being laid off (could not found a new job in time). His question is if he can apply for B2 and go to the US first, then stay in US looking for a job. After getting an offer, transfer his previous H1-b to a new company. Can he do like that? Thanks!

    Scenario:

    Working on H1. Wife is on H4. Waiting for our EADs.
    Planning to work for H1-GC sponsorer employer until (or I should say 6 months after) we get the GC.

    I am running a website and am planning to sell the advertising space?

    Q1: Can a H1 legally receive the money from website advertising on his/her website?

    Q2: Can a H1 register DBA?

    Q3: How about if H1 uses EAD, can then he register DBA and legally receive the money from website advertising? (I know once you use EAD your H1 becomes invalid).

    Q4: I know I can register DBA in wife's name when she receive EAD? Is that the only option I have?

    Please share your thoughts!

    WASHINGTON, Dec. 1 � Business lobbyists, nervously anticipating Democratic gains in next year�s elections, are racing to secure final approval for a wide range of health, safety, labor and economic rules, in the belief that they can get better deals from the Bush administration than from its successor.

    Hoping to lock in policies backed by a pro-business administration, poultry farmers are seeking an exemption for the smelly fumes produced by tons of chicken manure. Businesses are lobbying the Bush administration to roll back rules that let employees take time off for family needs and medical problems. And electric power companies are pushing the government to relax pollution-control requirements.

    �There�s a growing sense, a growing probability, that the next administration could be Democratic,� said Craig L. Fuller, executive vice president of Apco Worldwide, a lobbying and public relations firm, who was a White House official in the Reagan administration. �Corporate executives, trade associations and lobbying firms have begun to recalibrate their strategies.�

    The Federal Register typically grows fat with regulations churned out in the final weeks of any administration. But the push for such rules has become unusually intense because of the possibility that Democrats in 2009 may consolidate control of the White House, the Senate and the House of Representatives for the first time in 14 years.

    Even as they try to shape pending regulations, business lobbies are also looking beyond President Bush. Corporations and trade associations are recruiting Democratic lobbyists. And lobbyists, expecting battles over taxes and health care in 2009, are pouring money into the campaigns of Democratic candidates for Congress and the White House.

    Randel K. Johnson, a vice president of the United States Chamber of Commerce, said, �I am beefing up my staff, putting more money aside for economic analysis of regulations that I foresee coming out of a possible new Democratic administration.�

    At the Transportation Department, trucking companies are trying to get final approval for a rule increasing the maximum number of hours commercial truck drivers can work. And automakers are trying to persuade officials to set new standards for the strength of car roofs � standards far less stringent than what consumer advocates say is needed to protect riders in a rollover.

    Business groups generally argue that federal regulations are onerous and needlessly add costs that are passed on to consumers, while their opponents accuse them of trying to whittle down regulations that are vital to safety and quality of life. Documents on file at several agencies show that business groups have stepped up lobbying in recent months, as they try to help the Bush administration finish work on rules that have been hotly debated and, in some cases, litigated for years.

    At the Interior Department, coal companies are lobbying for a regulation that would allow them to dump rock and dirt from mountaintop mining operations into nearby streams and valleys. It would be prohibitively expensive to haul away the material, they say, and there are no waste sites in the area. Luke Popovich, a vice president of the National Mining Association, said that a Democratic president was more likely to side with �the greens.�

    A coalition of environmental groups has condemned the proposed rule, saying it would accelerate �the destruction of mountains, forests and streams throughout Appalachia.�

    A priority for many employers in 2008 is to secure changes in the rules for family and medical leave. Under a 1993 law, people who work for a company with 50 or more employees are generally entitled to 12 weeks of unpaid leave to care for newborn children or sick relatives or to tend to medical problems of their own. The Labor Department has signaled its interest in changes by soliciting public comments.

    The National Association of Manufacturers said the law had been widely abused and had caused �a staggering loss of work hours� as employees took unscheduled, intermittent time off for health conditions that could not be verified. The use of such leave time tends to rise sharply before holiday weekends, on the day after Super Bowl Sunday and on the first day of the local hunting season, employers said.

    Debra L. Ness, president of the National Partnership for Women and Families, an advocacy group, said she was �very concerned that the Bush administration will issue new rules that cut back on family and medical leave for those who need it.�

    That could be done, for example, by narrowing the definition of a �serious health condition� or by establishing stricter requirements for taking intermittent leave for chronic conditions that flare up unexpectedly.

    The Chamber of Commerce is seeking such changes. �We want to get this done before the election,� Mr. Johnson said. �The next White House may be less hospitable to our position.�

    Indeed, most of the Democratic candidates for president have offered proposals to expand the 1993 law, to provide paid leave and to cover millions of additional workers. Senator Christopher J. Dodd of Connecticut was a principal author of the law. Senator Hillary Rodham Clinton of New York says it has been �enormously successful.� And Senator Barack Obama of Illinois says that more generous family leave is an essential part of his plan to �reclaim the American dream.�

    Susan E. Dudley, administrator of the White House Office of Information and Regulatory Affairs, said, �Research suggests that regulatory activity increases in the final year of an administration, regardless of party.�

    Whoever becomes the next president, Democrat or Republican, will find that it is not so easy to make immediate and sweeping changes. The Supreme Court has held that a new president cannot arbitrarily revoke final regulations that already have the force of law. To undo such rules, a new administration must provide a compelling justification and go through a formal rule-making process, which can take months or years.

    Within hours of taking office in 2001, Mr. Bush slammed the brakes on scores of regulations issued just before he took office, so his administration could review them. A study in the Wake Forest Law Review found that one-fifth of those �midnight regulations� were amended or repealed by the Bush administration, while four-fifths survived.

    Some of the biggest battles now involve rules affecting the quality of air, water and soil.

    The National Chicken Council and the U.S. Poultry and Egg Association have petitioned for an exemption from laws and rules that require them to report emissions of ammonia exceeding 100 pounds a day. They argue that �emissions from poultry houses pose little or no risk to public health� because the ammonia disperses quickly in the air.

    Perdue Farms, one of the nation�s largest poultry producers, said that it was �essentially impossible to provide an accurate estimate of any ammonia releases,� and that a reporting requirement would place �an undue and useless burden� on farmers.

    But environmental groups told the Bush administration that �ammonia emissions from poultry operations pose great risk to public health.� And, they noted, a federal judge in Kentucky has found that farmers discharge ammonia from their barns, into the environment, so it will not sicken or kill the chickens.

    On another issue, the Environmental Protection Agency is drafting final rules that would allow utility companies to modify coal-fired power plants and increase their emissions without installing new pollution-control equipment.

    The Edison Electric Institute, the lobby for power companies, said the companies needed regulatory relief to meet the growing demand for �safe, reliable and affordable electricity.�

    But John D. Walke, director of the clean air program at the Natural Resources Defense Council, said the rules would be �the Bush administration�s parting gift to the utility industry.�

    If Democrats gain seats in Congress or win the White House, that could pose problems for all-Republican lobbying firms like Barbour, Griffith & Rogers, whose founders include Gov. Haley Barbour of Mississippi, a former chairman of the Republican National Committee.

    Loren Monroe, chief operating officer of the Barbour firm, said: �If the right person came along, we might hire a Democrat. And it�s quite possible we could team up in an alliance with a Democratic firm.�

    Two executive recruiters, Ivan H. Adler of the McCormick Group and Nels B. Olson of Korn/Ferry International, said they had seen a growing demand for Democratic lobbyists. �It�s a bull market for Democrats, especially those who have worked for the Congressional leadership� or a powerful committee, Mr. Adler said.

    Few industries have more cause for concern than drug companies, which have been a favorite target of Democrats. Republicans run the Washington offices of most major drug companies, and a former Republican House member, Billy Tauzin, is president of their trade association, the Pharmaceutical Research and Manufacturers of America.

    The association has hired three Democrats this year, so its lobbying team is split evenly between Republicans and Democrats.

    Loren B. Thompson, a military analyst at the Lexington Institute, a policy research organization, said: �Defense contractors have not only begun to prepare for the next administration. They have begun to shape it. They�ve met with Hillary Clinton and other candidates.�

    It has to be receipt date FIFO, but can never say how USCIS will processes.

    With my experience from Backlog Elimination Center's, USCIS works using a pure random function that gets seeded randomly from congress.

    Please let me know if 140 processing times is based on receipt date or notice date?

    I'm a concurrent 140-485 filer, filed on July 2 2007. My notice date on I-140 says August 16, 2007, where as my friend who filed only140 on july 2 has Notice date of july 12. Does that mean his will be processed first?

    my GC job title is programmer analyst(15-1021.00), and curently working as a Sr.Programmer analyst using EAD with different company.

    Now they are promoting me as a Applications Project Lead, most of my job dutie are same as programmer plus some additional role.

    Iam an H4 transferred to H1B. I am on H1B since one year. My pay is less than the one mentioned in LCA, but more than the prevailing wages. My job profile also includes some part of salary as comission, which I would get at the end of the year.     Hi all,


    I am a consultant working on H1B and my 3rd yr of visa expires in march 2011.
    Im planning to file my GC through my current employer in EB2 category(As I have a masters degree) but have following queries :

    1.My company is a small company with only 2 employees i.e. me and my manager.
    If i do file my GC through such a company,whats are the pros and cons e.g. any RFE expected because its a small company considering that have already had an RFE when transferring my H1B to this company earlier.


    2.Can I file my GC through a different employer say my end client or any other company while im working with my current employer?

    3.Considering the above situations,what is the best option for me to file my GC at tis point of time?

    Also filing my GC in EB2 category will help avid processing delays as per the current trend?

    Please advise.

    Hi, I am a U.S. Citizen, and my husband is not. I would like to apply for unemployment benefits, but I am worried that it may affect his immigration process. We will soon apply for his green card with the help of a cosponsor. I wanted to make sure that he would not be affected at all by me claiming unemployment benefits. I figure that it wouldn't affect him because of the fact that we will be using a cosponsor, but I didn't want to risk it.

    Folks,

    I have a question regarding travel while on AOS. We are on H1 and H4 (primary and dependent) but do not have the H1 and H4 visa stamps. Planning to use AP.

    When we leave the country, do we need to drop the H1/H4 I-94 stubs from the current visa approval forms OR the I-94 stubs issued during last entry? Ofcourse the I-94 nums on current visa approval forms and on visas last entered are the same, but different visa statuses when last entered US.

    Here is my situation:

    I94 expired on 2/12 and my H1b extension was filed on 2/24.

    Both my EAD and AP are expired (getting them renewed now).

    My 485 is pending status (PD is May 17th 2006).

    My lawyer says he requested USCIS to use discretion to grant H1B extension (with extension of stay) even though its filed late. If USCIS does not agree, I need to leave the country to get visa stamped (for H1b) in which case my pending 485 application can get affected.

    For that reason he doesnt recommend going that route if USCIS doesn't approve my H1B with extension of stay. He recommends to use my EAD to continue my work. My EAD is expired as well. Can I continue to work in this case (EAD pending renewal and H1b approved without extention of stay)?

    In the heady opening weeks of the 110th Congress, the Democrats' domestic agenda appeared to be flying through the Capitol: Homeland security upgrades, a higher minimum wage and student loan interest rate cuts all passed with overwhelming bipartisan support.

    But now that initial progress has foundered as Washington policymakers have been consumed with the debate over the Iraq war. Not a single priority on the Democrats' agenda has been enacted, and some in the party are growing nervous that the "do nothing" tag they slapped on Republicans last year could come back to haunt them.

    "We cannot be a one-trick pony," said House Democratic Caucus Chairman Rahm Emanuel (Ill.), who helped engineer his party's takeover of Congress as head of the Democratic Congressional Campaign Committee. "People voted for change, but Iraq, the economy and Washington, D.C., [corruption] all tied for first place. We need to do them all."

    The "Six for '06" policy agenda on which Democrats campaigned last year was supposed to consist of low-hanging fruit, plucked and put in the basket to allow Congress to move on to tougher targets. House Democrats took just 10 days to pass a minimum-wage increase, a bill to implement most of the homeland security recommendations of the Sept. 11 commission, a measure allowing federal funding for stem cell research, another to cut student-loan rates, a bill allowing the federal government to negotiate drug prices under Medicare, and a rollback of tax breaks for oil and gas companies to finance alternative-energy research.

    The Senate struck out on its own, with a broad overhaul of the rules on lobbying Congress.

    Not one of those bills has been signed into law. President Bush signed 16 measures into law through April, six more than were signed by this time in the previous Congress. But beyond a huge domestic spending bill that wrapped up work left undone by Republicans last year, the list of achievements is modest: a beefed-up board to oversee congressional pages in the wake of the Mark Foley scandal, and the renaming of six post offices, including one for Gerald R. Ford in Vail, Colo., as well as two courthouses, including one for Rush Limbaugh Sr. in Cape Girardeau, Mo.

    The minimum-wage bill got stalled in a fight with the Senate over tax breaks to go along with the wage increase. In frustration, Democratic leaders inserted a minimum-wage agreement into a bill to fund the Iraq war, only to see it vetoed.

    Similar homeland security bills were passed by the House and the Senate, only to languish as attention shifted to the Iraq debate. Last week, family members of those killed on Sept. 11, 2001, gathered in Washington to demand action.

    "We've waited five and a half years since 9/11," said Carie Lemack, whose mother died aboard one of the planes that crashed into the World Trade Center in New York. "We waited three years since the 9/11 commission. We can't wait anymore."

    House and Senate staff members have begun meeting, with the goal of reporting out a final bill by Memorial Day, but they concede that the deadline is likely to slip, in part because members of the homeland security committees of both chambers, the House Energy and Commerce Committee and the two intelligence committees all want their say. The irony, Lemack said, is that such cumbersomeness is precisely why the Sept. 11 commission recommended the creation of powerful umbrella security committees with such broad jurisdiction that other panels could not muscle their way in. That was one recommendation Congress largely disregarded.

    The Medicare drug-negotiations bill died in the Senate, after Republicans refused to let it come up for debate. House Democrats are threatening to attach the bill to must-pass government funding bills.

    Sen. Edward M. Kennedy (D-Mass.), chairman of the Senate Committee on Health, Education, Labor and Pensions, has proposed his own student-loan legislation, but it is to be part of a huge higher-education bill that may not reach the committee until June.

    The House's relatively simple energy bill faces a similar fate. The Senate has in mind a much larger bill that would ease bringing alternative fuels to market, regulate oil and gas futures trading, raise vehicle and appliance efficiency standards, and reform federal royalty payments to finance new energy technologies.

    The voters seem to have noticed the stall. An ABC News-Washington Post poll last month found that 73 percent of Americans believe Congress has done "not too much" or "nothing at all." A memo from the Democratic polling firm Democracy Corps warned last month that the stalemate between Congress and Bush over the war spending bill has knocked down the favorable ratings of Congress and the Democrats by three percentage points and has taken a greater toll on the public's hope for a productive Congress.

    "The primary message coming out of the November election was that the American people are sick and tired of the fighting and the gridlock, and they want both the president and Congress to start governing the country," warned Leon E. Panetta, a chief of staff in Bill Clinton's White House. "It just seems to me the Democrats, if they fail for whatever reason to get a domestic agenda enacted . . . will pay a price."

    Republicans are already trying to extract that price. Sen. Jon Kyl (Ariz.), chairman of the Senate Republican Conference, said Democrats are just "trying to score political points on the war. . . . Part of their party can't conceive of anything else to talk about but the war."

    Norman J. Ornstein, a Congress watcher at the American Enterprise Institute, said a Congress's productivity is not measured solely on the number of bills signed into law. Bills and resolutions approved by either chamber totaled 165 during the first four months of this Congress, compared with 72 in 2005. And Congress recorded 415 roll-call votes, compared with 264 when Republicans were in charge and the House GOP leaders struggled to impose their agenda on a closely divided Senate.

    Democratic leaders remain hopeful that a burst of activity will put the doubts about them to rest. They have promised to pass a war funding bill and a minimum-wage increase that Bush can sign, to complete a budget blueprint and to finish the homeland security bill by Memorial Day. The House wants to pass defense and intelligence bills, its own lobbying measure and the first gun-control legislation since 1994, which would tighten the national instant-check system for gun purchases. The Senate hopes to complete a comprehensive overhaul of immigration laws.

    Rep. Chris Van Hollen (Md.), chairman of the House Democratic campaign committee, said his party needs to get some achievements under its belt, but not until voters begin to focus on the campaigns next year. "People understand the Democrats in Congress are doing everything in their power to move an agenda forward, doing everything possible to change direction in the war in Iraq, and the president is standing in the way," he said.

    Kyl was not so sanguine. If accomplishments are not in the books by this fall, he said, the Democrats will find their achievements eclipsed by the 2008 presidential race. Panetta agreed.

    "This leadership, these Democrats have shown that they can fight," he said. "Now they have to show they can govern."

    Hi all,

    I filled I-485 in 2007. Now I am waiting on the status adjustment and I have a quick question about job changes.

    A starting-up company with only 2 employees has got a contract outside U.S.. They need to hire somebody to work for them outside U.S. for 1 year maybe longer. I happen to be their best candidate. My question is whether a small company like this one is able to sponsor me to get my GC. Does USCIS have minimum requirements for a company which can sponsor employees' GC application? For instance, a company must have at least 30 employees or over $3 million revenue. I really want this opportunity. But I don't want to ruin my GC application.

    Hello All,
    As per the latest regulations, the employer has to pay for all the labor application cost. My employer has agreed to do my green card, but are little hesitant to pay the cost (due to budget constraint). What legal options/adjustments can I make with my employer so that the cost process is not delayed? Can they deduct part of my salary to bear the cost etc...?

    I am not sure if it was posted before, the immigrant visa fee will go up to $400 from $380 effective January 1, 2008.

    Also, Bombay and Madras consulates switched to NVC appointment processing (NVC takes over the scheduling of immigrant visa appointments). Delhi and Calcutta are still standard processing posts, but expect them to be converted in the near future as well.
    Chinese, Japanese, Australian and some other (mostly Asian) consulates still follow standard processing, but expect them to be converted in 2008 as well.

    They convert consulates without any notice to the public, so always check here before sending in DS-230 and supporting documents:

    My wife will be coming back from India during first week of Dec thru IAD. She has some type of infection in few of her fingers with few blisters. I am worried her fingerprinting at POE may not work and may show an error. Has anyone encountered this issue ever? Do they capture all 10 fingers? Her infection is only in few fingers.
