I am wondering what kind of resistance, if at all, is the IV seeing in democratic controlled senate and congress seeing since these bills can be viewed as big business-supported or republican supported.
It would be good to get more democrats to sponsor these bills rathar just have them give lip service to our cause since they have the majority.

I noticed they have a Calls to Action from Groups and Organization on the home page, When i tried to see if there are any Immigration related issues posted There were many like increasing H2A etc but nothing corresponding to Retrogression or GC waiting faced by thousands of immigrants.
There are 100s of bills waiting for Co-sponsors published on this website.
I felt we should do post about the issues faced by Thousands of Legal immigrants who are struck in retrogression or Per country limit.
This may be a good place to put as a number of representatives may view it and it is a good way for us to let the people know of the issues.
Any thoughts........

prevailing wage calculations for EB-2 applications to be filed for Sr. Systems Analyst and Sr. Software Engineer. As of January 1, 2010, these wage requests have to be filed using US DOL�s electronic iCert system. For the past couple of years, the NJ DOL had given us LEVEL II wages for these positions. Now, US DOL is giving us LEVEL III wages for these positions which is at $102,274
EB-2 Software Engineer/Systems Analyst LEVEL III at $102,274 , or file under EB-2 ITPM LEVEL II at $116,501
I wanted to confirm whether these wage Calculations Declared by DOL are correct to file for EB2 category and do we need to quote such high salary ranges.I have master's degree plus 5+years of Experience in IT field.So, i will qualify for EB2 category but only wanted to confirm whether the wages declared by DOL were correct in respect to Jan 2010
Anyone or the concerned attorney can you please clarify on this.

My spouse H4 extension was filed in Jan 2011 and I was under impression that receipt is with lawyer. But recently I came to know that it should come to my address, as of today we have not got receipt no. I am still waiting for H1 approval decision and know H1 receipt no.

My wife is on H4 currently (came into USA on H4). We are planning to apply for her H1 in April. Once it is approved, we are planning to to CANADA for H1 stamping.Her current H4 visa expired in 2006. I-797 is valid till May 2007.
How easy is to get new H1 stamping (from H4) in CANADA?
What issues you face?
She has a US masters Degree?

I am planning to visit India for a10 days in October. I have a valid h1b status till 2010 which I thinking of getting stamped at new delhi. But it seems the PIMS verification delay is making people wait for weeks and months. I have an AP which I can use to enter as an alternative. But I wanted to know if anyone had experience in stamping at the delhi consulate? Do they keep the passport if it is send for PIMS verification? In that case I'll drop the idea of getting it stamped and use my AP (though I want to avoid doing that snce I want to maintain my h1b status).

Last Friday was a depressing day for me. A businessman and his daughter visited me in my office. When I asked how they had learned about our law firm, they said a lot of flattering things about how "famous" we were and about our "great" website. However, when I analyzed their case, it quickly became apparent to me that nothing could be done to help them. It was too late. I'm sure the lawyers have already told you that this is not possible. The company cannot refile PERM now because all the ads, posting, etc are too old. They would have to start again.

No that's not the case, there are stringent reqmts for proof of Date of Birth. Passport is not one of them...
Please check other forums where this has been discussed..

I work for a big 4 consulting firm and transferring my H1-B to a client (a 2 Billion dollar american company).......I'm planning to join my new company only after the visa has been transferred ........my questions are:
1.) If the transfer is rejected, can I work for my current employer (assuming I dont resign)
2.) My wife's on H4 and recently applied for COS from H4 to F1 - Do I need to file for her H4 transfer also or not?
Not sure what's the effect of H1 transfer on wife's pending H4 to F1 application.
Need help ASAP. Thanks a lot.

I have been searching in the inernet for quite some time and looks like
the following questions are still not answered properly. So any of you here who actually used the AC21 in the past can answer the below questions and it will help lot of people on this board.
1) When the employee don't have I-140 receipt number and I-140 approval copy , is it okay to use AC21 after 180 days ?
2) Do we need to have I-140 approval copy for the EAD renewal ?
Guru's please help

My AP approvals are lost in mail, my employer mailed them in ordinary mail during holiday season (12/11/07). What can I do next? Go thru attorney for duplicates? Please advice.
