Yes for extensions - Auto revalidation only from contiguous countries - Canada, Mexico and some islands.

Hello gurus,
My H1 expires in march 2009, I have valid EAD and AP, I want to renew my H1to be on the safer side.
My wife made use of her EAD for few months and now she is not working, and we are planning to visit India for few weeks next year and get H1 and H4 stamped.
here are my questions:
1. Can my wife get her H4 extension when I apply for my H1 extension ?
2. Does USCIS know that she used her EAD (Is there a way that they can find out) and will there be any problem in approving H4 extension ?
3. Now that she is not using her EAD, Is she back on H4 status ? She came here as H4 and never made a trip back.

I am doing my second masters from a university with a valid i20. I have a CPT till the end of Aug 2008. I have a approval notice for H1B with start date of OCT 1 2008.
I am planning to discontinue the course from Fall (Starts sep 1st) 2008. Because there is only one month gap between Fall Semester and H1b start, is it possible i stay in the US without taking any courses at the university. i do not mind not working if i have an option to stay back in US till oct 1st.
i am trying to avoid a hefty fee for the whole semester, i need to fill the gap from SEP 1st 2008 to OCT 1st 2008

Mr. Obama might want to consider transferring the authority of setting quotas from Congress to the Labor Department
May be good or bad, depending on how you look at it....we will then be at the mercy of PERM...
If the Labor Department determines that a foreign worker would not displace Americans, that worker should not be barred from entering the country due to an arbitrary quota
This should definitely be high on the agenda.....although its very doubtful if this can ever be implemented.

I applied I-140 in EB2 NIW category. I need to apply for H1 extension as this is my 5th year. I need to talk to my employer.
I see because of retrogression one cannot file for I-485.
Can I file for extension of H1 after I get I-140 approval or do I have to wait for I-1485 filing.

Hi,
My attorney has filed our AOS on July 30th. She didnt had time foR filing our EAD & AP. So I'm applying myself.
My wife was out of status and is under 180 days. Her AOS will be considered under 245(k).
Now to file her EAD & AP, do I need to attach any Cover letter explaining her status? or the documents that are required will be sufficient? Please some one throw some light and let me know how to proceed.

How easy is to get new H1 stamping (from H4) in CANADA?
What issues you face?

Please help me with this. i came to USA on L1B visa in 2005 with 1 year petition and got extension for 2 more years i.e till feb 2008 but went to india for good in June 2007.
Again we came back with new L1B petition in Oct 2007 and got 3 years visa i.e, till Oct 2010.
1) Now if company apply for extension on L1B how many years ext i'll get?
2) Now if Company B wants to file new H1B for me, how many years of visa i'll get.
i was never on H1 before this is my first time H1B.
Please help me with this as soon as possible.

Since I am a canadian citizen, I do not require a visa for US and hence I don't have a H1B visa stamped on my passport.
Since you know this point, I am sure the American Visa Officer working in various consulates, too, would know this. If not, send a copy of the law that says "Canadian citizens do not need Visa to enter US".
